Rental house issue, tenant had stroke

Home is in corona. 1/2 month behind on rent. While I was on vacation he had a stroke on the Feb 4th. Daughter reached out to me via text. ( she’s not on lease) she just informed me he will need end of life service. This is all by text so I don’t know his real condition, if he can talk, or make decisions, or will never return, etc.

She has asked me how long can she have his stuff in the home. I’m like if you want to pay the rent until the end of the month, then 3 more weeks. She’s his only daughter. She said she just had kidney surgery 3 weeks ago and not physically able to move anything and she can’t pay the rent as she has no job and hasn’t worked for 3 years.

He has always paid his rent for 6 years. but in the last 6 months with a late fee (usually by the 20th of the month) I have offered to help move his stuff out but she’s not on the lease so could get sticky

I’m sure I have rights and he does. Not sure what right he has if he stays alive or if he passes.

Any advice or direction would be helpful. he is like 75 years old. She’s probably 45 and lives in Utah but is down at the moment trying to fix his affairs POA etc
 
If she gets the POA....I'd think that you'd be good as far as her not being on the lease.

Go see him and see what he says.....assuming that he can talk and is not comatose. If he is comatose, then you'se gotta ta do it.

I assume that he's paid 1st and last month's rent when he moved in....or a security deposit. Sooooo, you could take his deposit and give them more time. Or, give them more time and refund the unused part of it.

If you don't help her....you may have to do it anyways.

You want the place vacant so that you can rent it again....duh. You'd be a "Swell Guy" if you helped her, and actually be helping yourself at the same time.

Assuming that he is not currently living there you would be money ahead to rent a storage unit for a month and pay someone to move his stuff to that unit. Give her the key if she shows up with a POA. What do you have to lose money wise if she shows up with a POA and occupies your property for a lengthy time rent free? On your next lease have a spot where they state who they want you to release their property to in case they pass on.
 
Sounds like he’s pretty a pretty solid tenant for the past 6 years. I’d give her some time, like until the end of the month. Help her arrange donating & packing up his stuff. Give a little get a little.

If he’s in the house still you might be f’d until he passes. I can’t see a California judge evicting him. That process is going to take time regardless.

Not that it matters but my .02.......... Is it going to hurt you financially to cut them some slack? We all like to think if we are in a position to help someone in their time of struggle, we would? Probably see if you can find him and call her and speak to her. Set some firm timelines, but helping those in need is a blessing for both of you. I'm sure the family is going thru hell right now, any small gestures would be probably welcomed.
 
I would make it as easy as possible for the family within reason. Last thing you’d want is them all pissed off pouring concrete down the drains because they’re disgruntled.

My parents allowed a tenant live in the house for free for 3 months during a difficult time. No regrets, no sleep lost, another on the list of good deeds done.
 
Do what's right for you, if it was me I would totally cut them slack if he was a good tenant,

We have some great realtors and property managers here that I would ask. Tread carefully..

Thanks for the replies, keep them coming. this ^^^^^ seems like the right approach. from what i gather he is not in the house and probably never will be again. I am compassionate and willing to help but she is not really giving me much info (or at least answer all of my questions) i really just want to know where he is so i can go see him (we have always been on good terms, rent is a lot lower than the going rate) if he can talk, then he might have different things he would want me to do then she does.
 
If he can use his hands, he can still write you a check, hope you can go see him. If she gets POA, then she can pay you from his account. I am sure there are other bills as well that are being left in limbo. Sucks for all.

If things go too much beyond this month without rent or movement towards vacating, let her know you'll be sending a non-payment notice. No hard feelings, but just what you have to do. Discuss it via phone so there is no confusion on their part on your kind/caring attitude on this.

Working with my Dad to get out of a situation with a shitty tenant at one of his houses who sob-story'd him for 6 months, only paying 3 months' rent in 8 months time. They kept stringing him along with promises and excuses, but when the rent was due, they disappeared. Once the eviction finally came, the true colors showed up and the dude threatened to destroy the place. They're out at the end of the month, so we'll see how FUBAR it is. Almost all of my dad's conversations with the tenant were via text and they read everything with an "asshole" tone to it, so every step of the way became worse.

Compassion is absolutely lauded and the right course of action here, but carry the bat anyway.
 
Don't let being compassionate, which I agree with, be mistaken for being a sucker. Set clear limitations and deadlines.
 
i have done this in the past. I had a couple die within weeks of each other, the family contacted me and i let them use the deposit (since they were very nice folks, older and very clean) to cover a months rent. I told the family take everything you want leave what you don't i'll handle disposal. I knew it was a tough time for them losing them so close together.
I also had a buddy who took and moved all his tenants belongings into a storage. they video'd it all, he paid 3 months rent in the guys kids name, and told them it was theres, if they let it go thats all on them.
whatever you chose, DO NOT allow her to skate on terms, if you say the first, stick to it, otherwise she will drag that out for months.

BUT follow the letter of the lease also. I had a guy who stored a car at our storage. he got behind during covid and I bent over backwards to give him a way out. and when I finally got to the end of my rope, he said you have to give me notice, even though I had all the texts back and forth, waving late fees' and to the point where i just said come get it, free and clear just get it out. He wouldn't. so i hired a tow truck had it towed to his house and dropped it out front in the street lol. he was pissed, but hey its your car lol, belongs in your yard.
 
finally had a phone call with the daughter and fiancé. they said he cannot move or talk but is alive. the stroke happened in a doctors office. they just got here two days ago and need some more time as they don't have the final word from the doctors on his prospects or condition. doesn't sound good

they said they would call me next week early and get a game plan. i was at least able to tell them my issues and concerns and hopes and that i would be supportive of their situation too

Don't let her stay in the house while here visiting dad, you don't need a squater setting up residence.
