what do you think? shipping freight collect issue

Had Bend Oregon ship a motor to me 1 year ago, freight collect.  none of my main guys were here,  I never have freight shipped to me collect.  an employee of the shop next door signs for it.  we build an engine, dont know about the freight collect,  customer paid for his motor and the shipping back to them.  we ship the motor back, i think it was from an employee from Bend Oregon (that worked there) who originally shipped it.  

two weeks after he receives his motor we get a freight charge of a whopping $1100  like what the crap.  anyways our employees did not sign for it.  we called customer and he went dark, not paying.  

then i get a call out of the blue a few days ago from a collection agency saying i owed the bill plus a few more hundred.  she said shes an asset investigator.  i ask her what assests are you investigating, she tells me Outfront motorsports and she give me my own home address and says that too.  (I'm incorporated)

i tell her what happened and then she tells me this is my last chance to take care of the issue, i am liable and tells me about title 49?

and tells me it doesnt matter who signs the BOL, i say even a guy walking past my shop?  she says anybody.  and states its because of "parent authority"  never heard about that either

not thinking im going to do anything--this is bogus,  what do you who do a lot of shipping think?

 
Those collections agencies will say anything to get money out of you. I wouldn't pay that. Make them jump through so many hoops that it becomes not worth their time to bug you.

 
Its a civil matter. If she continues to harass you for $$$, get the police involved. Otherwise they will threaten you with this and that and do nothing. Do not give in to them. they will eventually go away

X2  and if she persists start billing her for administrative work to figure out her clients shipping eff up. You have a 250$ labor rate 1hr minimum; it will add up fast and they will lose interest

 
Fwiw shipping companies will not release items freight collect without a check in hand. Sounds like a scam

 
Can not collect if they do not have a legitimate SIGNED contract, Invoice etc....

 
I’d send a certified letter to your customer asking for clarification about the shipping. Then I’d send a certified letter to the collection agency stating that you’ll bring your copy of the freight invoice to court along with the guy who signed for it.

I had a similar thing happen with several calls from the trucking company and their collection agency. Never did get a notice to appear in court. 

 
Depends on how many engines you have shipped,  I do not do mine direct ship,  i always do a dock/terminal pickup, if there is any issues i can solve it there,   It is very convenient to have is shipped straight to the shop, but very little issues with terminal pickup, takes very little time out of the day,

There next step will be small claims court in what ever state they are in and if you don't show they get the judgment against you plus more fees and a bad credit report. I would find a quick way to settle this it's only going to get worse. I would send them a check and ask them how to file a claim against whoever sent you the mirror. Talk to your attorney asap.

Send a check for something he didn't know about or even sign for? If he sends a check that complaint is going to sit in the bottom of someones desk until the end of time. A bad credit report is not the end of the world. Especially if you have no plans to take out a loan in the future. Once a check is received they, the original company and the collection agency, are DONE and will expend no further effort on this.

We have used collection companies for unpaid invoices. Never once has a collection company actually received any of our money. Everyone just blows them off and then we never get paid. The collection company just says "sorry, we couldn't collect". So you being on the other side, it sounds like you can just blow them off.

collection agencies do not care about anything but the money (debt they bought)Nothing else and will try and threaten and get sneaky.No wonder why they get blown off but yet some fall for their antics.

I have dealt with one about an ID theft where my name was used for a phone years ago,they didnt care about the police report,the claim i filed etc only wanted money when i asked them to produce the actual paperwork where i signed and prove its my signature they resorted to name calling and guy said he will come to my house to collect it i told him do what you gotta do i will be here never heard from them after that.

 
Glad to hear it was resolved. It's a very frustrating thing to deal with.

it was an employee who shipped it from the Dealership.  he tried to pay the freight when it was picked up but the driver wouldn't take cash,  said just mark the box freight collect

the issue came after we shipped his rebuilt motor back (not realizing we were billed for freight collect).  so when the bill came to us we refused to make the payment and told them to contact the owner.  issue is the owner now was unwilling to pay them or us.  once Bend Oregon got involved i think they forced his hand.  I did finally talked to the owner of the motor and now he was cooperative and very nice on the phone (but for the last 6 months he ghosted us), wouldn't return emails or voice mails
