Head on in Glamis yesterday. Questions....

Friend was involved in a head-on yesterday at G.  He was stopped and another car hit/landed on him.  Thankfully no one hurt (most important thing), but how does it work with insurance, who is at fault, etc?  'Supposedly' the other drive was under the influence of a 'white powdery substance'.  BLM and CHP were involved.  Is CHP even out there?

Was CHP involved?  Then I guess they are out there.  Unless BLM contacted them due to circumstances.   

Any other details?  When, where, what vehicles...

 
Friend was in a small rail, went up a hill (IDK where) and was about to come down.  Stopped before coming down.  Another vehicle (looked like a 4 seat SxS) came up the hill (no spotter) and landed on the small rail.  Bystander caught it all on video.  BLM was called and they referred it to CHP.  IDK any more details than that.  I was under the impression that glamis was a 'no fault' area and everyone fixed their own toys in these unfortunate incidents.

It is a no fault area. We had a three car pile up all three had insurance and insurance paid for each car and each driver paid his own deductible. The insurance company didn't even ask if others were involved or what there name was. 

Hopefully your buddy had insurance to cover the damages to his car. Best case is the other guy pays for his deductible worst case he says pound sand and besides taking him to civil court there is nothing you can do but pound sand.

IMO, the cost of the repairs are not a big deal.  Just glad no one was hurt although there was almost an altercation after the accident......

 
Can someone post the rule that says the no fault? My parents got hit while they where parked and the other person that hit them is talking them to court. 

 
Its a no fault area.....HOWEVER, if it is proven that the party was under the influence then all bets are off. You now have a case.

Glad nobody was hurt / there are some VERY dangerous situations going on out there right now!

In that case the other driver should have to have to go to the hospital due to his post accident injuries.

This is correct and was explained this way by CHP when a buddy was involved in an accident years ago. The dude on a dirt bike was under the influence.

Unless the CHP or BLM documented the other driver as Under the influence or cited that person as DUI, there will not be anything they can do.

If they weren't hauled off under arrest, they weren't DUI.  

 
Hold up, powdery substance? What kind of language is that? We need the full details! Aren't people straight thrown in the slammer for that stuff? How's that going to hold up if there isn't evidence of said substance? Really curious is all. Was it just hanging out his nose? There's more to this story apparently.

Part of me feels I am missing out by no longer going on holiday weekends, but the other half of me is glad I'm nit around the chit show and the f'n idiots that make it dangerous.......
Have not been out on a holiday weekend in a very long time. I really enjoy the dunes when empty, like summer runs.
